E-cigarette terms and conditions

Purpose

The Kent Smoke free service is implementing a service to provide approximately 744 smokers in Kent the opportunity to access an e-cigarette starter pack and a four-week supply of e-liquids free of charge to use as part of their quit attempt, alongside behavioural support.

E-cigarettes can be used as a stand-alone product for a quit attempt or in combination with Nicotine Replacement Therapy – this will be discussed with the smoke free adviser at appointments.

Current evidence available shows e-cigarettes are highly effective when combined with behavioural support, cost effective, safe and appealing to smokers. The service is also targeted to ensure smokers that engage with the service are from a Routine and Manual occupation and /or more disadvantaged groups within the community. Evidence shows that e-cigarettes are particularly appealing to those from disadvantaged groups.

This will be delivered by Kent Community Health NHS Foundation Trust (KCHFT) One You Smoke Free service which is commissioned by Kent County Council (KCC). Funding for this is being provided by Kent County Council (KCC). E-cigarette starter packs will be provided directly by Totally Wicked who are an Independent British Vape Trade Association (IBVTA) registered Vape retailer.

Who can access this offer?

Any smoker in Kent over the age of 18, who has smoked tobacco within the last two weeks and is accessing and engaging with the Kent One You Core Smoke Free Service for support to make a quit attempt.

What is included?

Each client who wishes to use an e-cigarette will be issued with a single use voucher code and explanation on how to order online. An alternative process will be available for ordering for clients who do not have access to the internet.

Each starter kit includes 1x e-cigarette (available in a choice of colours), 2x atomizers, 1x USB WALL adapter and 5x e-liquids available in 6 flavours and 3 nicotine strengths (0.6%, 1.0%, 1.6%) and 1x user manual (clients are able to mix and match flavours and strengths). The e-liquid provided within the starter kit is enough supply for two weeks and clients can purchase further e-liquids for this device via the Totally Wicked website or an alternative retailer of their choice at the Recommended Retail Price (RRP).

Following successful engagement with the smoke free programme, from session 3 clients can access a further incentive voucher code which will be provided to the client to redeem against another 5x e-liquids available in all strengths (0.6%, 1.0% and 1.6%) and all flavours (clients are able to mix and match strengths) via the landing page.

Full terms and conditions

  1. KCHFT will provide information to the client documenting their responsibilities for using an e-cigarette as a quit aid, to include informing their GP of their quit attempt if they are using medication that will require dose adjustment, agreeing to complete patient experience surveys and agreeing to set a quit date by week three of the programme. Clients will also be provided with an overview of how the device operates by a trained One You Smoke Free Adviser.
  2. Clients accepting the e-cigarette will be provided with one voucher code by their KCHFT Smoke Free Adviser and access to a bespoke Totally Wicked landing page on the Totally Wicked website. The voucher may be redeemed against 1x SKOPE S e-cigarette starter pack and 5x Switz e-liquids (0.6%, 1.0%, 1.6%) in menthol, mixed fruit, strawberry, iced blackcurrant, tobacco and rolling tobacco flavours.
  3. An alternative process will be available for ordering for clients who do not have access to the internet via telephone to Totally Wicked Customer support.
  4. Following successful engagement with the smoke free programme, from session 3 clients can access a further incentive voucher code will be provided to the client to redeem against another 5x e-liquids available in all strengths (0.6%, 1.0% and 1.6%) and all flavours (clients are able to mix and match strengths) via the landing page.
  5. Totally Wicked will take on all responsibility for maintaining the KCHFT landing page website and shipping the devices and e-liquids direct to the client.
  6. Totally Wicked will comply with the Tobacco and Related Products Regulations 2016 (TRP), providing a copy of the appropriate public liability/product insurance certificate and complying with the General Products Safety regulation 2005 which states;

No producer shall place a product on the market unless the product is a safe product.” When procuring shortfill liquids, vendors should carry out the same due diligence that they already do with nicotine containing liquids, and in particular should request evidence that these products have been tested as per the producer’s responsibilities under GPSR.

  1. KCHFT will deliver the 7week programme of support alongside the provision of the E-cigarette.
  2. KCHFT will ensure that clients using an e-cigarette are provided with information around any medication that may require dose adjustment and advised to inform their GP of their quit attempt.
  3. KCHFT will not be liable for any loss or harm resulting from any defective supply, of any goods, services or any other items for which the voucher is used.
  4. E-cigarette starter pack and e-liquids will be provided free of charge to the client accessing the service. KCHFT will reimburse Totally Wicked the cost of all starter packs and e-liquids supplied following receipt of any invoices submitted on a monthly basis.
  5. “Clients can purchase additional e-liquids for this device via the Totally Wicked website or other retail outlets at the Recommended Retail Price (RRP).  KCHFT will not be held accountable or liable for any loss or harm should clients choose to purchase e-liquids from a non-IBVTA registered retailer.”
  6. KCHFT will conduct patient experience surveys with all clients to obtain outcomes and feedback of the service users’ experiences.
  7. Formal complaints will be dealt with in accordance with accepted NHS Complaints Procedure by Totally Wicked. KCHFT will provide Totally Wicked with a copy of the NHS complaints procedure.
  8. Both Parties will ensure that all information is handled securely and confidentially in line with legislation, organisational policies/procedures and best practice and that all breaches are notified to the KCHFT Information Governance Compliance Manager via the KCHFT One You Smoke free service within 24 hours.
